TERMS & CONDITIONS
These Terms & Conditions apply to bookings and use of Culinary Cruiser services. They should be read together with our Privacy Policy.
1. About These Terms
These Terms & Conditions apply to bookings and use of Culinary Cruiser services. They should be read together with our Privacy Policy. Nothing in these Terms is intended to exclude or limit a right or remedy that cannot lawfully be excluded or limited under South African law.
2. Business Details
Culinary Cruiser
CIPC registration number: 2025/433912/07
3 Hildebrant Street, Macassar, Western Cape, 7130, South Africa
Website: culinarycruiser.co.za
Email: Dine@culinarycruiser.co.za
3. The Culinary Cruiser Experience
Culinary Cruiser provides a moving dining experience on a double-decker bus. The route and operating arrangements may vary where reasonably necessary for safety, weather, traffic, operational requirements or other circumstances outside our reasonable control.
4. Booking Channels
Bookings may be made through Dineplan, email, telephone, WhatsApp or other booking channels expressly made available by Culinary Cruiser. A booking is subject to availability and is only confirmed when Culinary Cruiser or the applicable booking platform confirms it.
5. Booking Confirmation and Information
Guests are responsible for providing accurate booking information, including the number of guests, contact details and relevant dietary or allergy information. Culinary Cruiser may rely on information supplied by the customer when preparing and operating the experience.
6. Pricing and Payment
Prices are those communicated or displayed at the time of booking. Depending on the booking, Culinary Cruiser may require a deposit, partial payment or full payment. The amount and payment deadline will be communicated during the booking process. Payment methods may include Dineplan, Yoco and EFT/direct bank transfer.
7. Private Charters and Functions
Private charters/functions generally require a minimum of 12 guests and a 50% deposit unless a different arrangement is agreed in writing. The remaining balance is payable according to the payment deadline communicated for the event.
8. Private Booking Cancellation Policy
For private bookings, the following deposit policy applies, subject to mandatory rights under applicable law:
- 14 or more working days before departure: the full deposit is refundable.
- Less than 14 working days but more than 7 working days before departure: 50% of the deposit is retained and the remaining 50% is refunded.
- 7 working days or fewer before departure: the deposit is non-refundable.
Where a deposit is retained under this cancellation policy, the customer will not become liable for the unpaid balance solely because of the cancellation.
9. Ordinary/Scheduled Booking Cancellations
Cancellation terms for ordinary bookings may depend on the booking channel and the terms displayed at the time of booking. For Dineplan bookings, the Dineplan cancellation/payment terms displayed during the booking process also apply. Where Culinary Cruiser has separately communicated a cancellation policy for a direct booking, that policy will apply subject to applicable South African law.
10. Minimum Number of Guests
Culinary Cruiser requires a minimum of 12 guests for an operating departure unless otherwise expressly agreed. If a scheduled departure does not reach the required minimum, Culinary Cruiser may cancel, postpone or reschedule the departure. Where Culinary Cruiser cancels for this reason, affected customers will be offered a choice of a refund of amounts paid to Culinary Cruiser or an alternative date, subject to the applicable booking arrangements.
11. Cancellation by Culinary Cruiser
Culinary Cruiser may cancel or suspend an experience where reasonably necessary because of severe weather, unsafe road or vehicle conditions, mechanical or operational issues, legal requirements, insufficient minimum bookings, or other circumstances affecting the safe or practical operation of the experience. Where Culinary Cruiser cancels, we will generally offer the affected customer a choice between rescheduling and a refund of amounts paid to Culinary Cruiser, subject to the circumstances and applicable law.
12. Weather and Route Changes
The route may be changed where reasonably necessary, particularly because of adverse weather, road conditions, safety concerns, traffic restrictions or operational requirements. A route change does not automatically entitle a guest to a refund where the experience can still reasonably be provided.
13. Delays
Traffic and other road conditions may cause delays and are not automatically within Culinary Cruiser’s control. Where a delay becomes significant, including a delay of approximately one hour or more, Culinary Cruiser will assess the situation and communicate with affected guests where reasonably practical. Ordinary traffic delays do not automatically create a right to a refund or compensation.
14. Arrival and Departure
Guests should arrive at the communicated departure location in sufficient time for boarding. Late arrival may reduce the time available for the experience and may, depending on circumstances, result in a guest missing departure. Culinary Cruiser cannot guarantee that a moving vehicle can wait for late guests. A failure to attend without prior cancellation (“no-show”) does not automatically entitle the guest to a refund.
15. Age Requirements
Standard Culinary Cruiser experiences are for guests aged 13 and older. Guests under 13 may attend only for private bookings or other arrangements where Culinary Cruiser has expressly agreed to their attendance.
16. Accessibility
The bus is not currently wheelchair accessible. Guests must be able to board using stairs and move through the vehicle as reasonably required. Guests with mobility, medical or other accessibility needs should contact Culinary Cruiser before booking so that we can explain the current limitations and determine whether the experience is suitable.
17. Safety While the Bus Is Moving
For safety, guests must remain seated while the vehicle is moving unless movement is reasonably necessary, such as using the toilet. Guests should inform a waiter if they need assistance or need to move through the vehicle. Guests must not lean out of windows, interfere with vehicle equipment or controls, distract the driver, or behave in a manner that creates a safety risk.
18. Smoking, Vaping and Dangerous Items
Smoking and vaping are not permitted on the bus. Guests may not bring or use dangerous, unlawful or prohibited items, or anything that creates an unreasonable risk to people, property or the vehicle.
19. Guest Conduct
Culinary Cruiser expects guests to behave respectfully toward staff and other guests. We may take reasonable steps to address disruptive, threatening, abusive or unsafe behaviour. Where necessary and lawful, a guest may be refused further service or required to leave at a safe and appropriate location.
20. Alcohol
Culinary Cruiser holds a liquor licence and may supply alcohol as part of its services. Guests may not bring their own alcohol onto the bus. Culinary Cruiser may refuse or limit alcohol service where reasonably necessary, including where a guest appears intoxicated, is behaving unsafely or unlawfully, or where continued service would create a risk. Guests remain responsible for their own conduct and for complying with applicable alcohol laws.
21. Dietary Requirements and Allergies
Guests must accurately disclose relevant dietary requirements and allergies when booking and notify Culinary Cruiser of any changes as early as possible. We will take reasonable steps to accommodate disclosed requirements, but we cannot guarantee an allergen-free environment. Culinary Cruiser cannot reasonably be responsible for an allergy or dietary issue arising from information that was not disclosed to us, subject always to rights and liabilities that cannot lawfully be excluded.
22. Menu and Service Changes
Menus, dishes, ingredients, wines, route details, seating arrangements and other elements may change where reasonably necessary due to availability, seasonality, supplier issues, safety, operational requirements or other circumstances. We will endeavour to provide a substantially comparable experience where changes are necessary.
23. Personal Belongings
Guests are responsible for their personal belongings. Culinary Cruiser is not responsible for loss or damage to personal property except to the extent liability cannot lawfully be excluded.
24. Damage to Property
A guest may be held responsible, to the extent permitted by law, for loss or damage caused by their intentional or negligent acts to Culinary Cruiser property, equipment or other property.
25. Photography and Video
Photography and video may take place during experiences. Guests may appear incidentally. Where identifiable imagery is intended for marketing or another use requiring consent or notice, Culinary Cruiser will use an appropriate process. Guests who do not wish to appear in marketing material may notify staff or Culinary Cruiser before or during the experience.
26. Medical Emergencies
Guests should inform Culinary Cruiser of relevant medical or safety information where it is reasonably necessary to provide the experience safely. In an emergency, Culinary Cruiser may contact emergency services and provide information reasonably necessary to protect the guest or others, subject to applicable law.
27. Insurance
Culinary Cruiser maintains public liability, passenger liability and vehicle insurance. Insurance does not remove a guest’s responsibility to follow safety instructions or applicable law.
28. Force Majeure and Events Outside Our Reasonable Control
Culinary Cruiser will not be responsible for failure or delay caused by circumstances outside our reasonable control, including severe weather, road closures, accidents or major traffic disruption, government restrictions, utility failures, supplier disruption, strikes, mechanical failures or other events that make operation unsafe or impractical. Where appropriate, we will offer rescheduling or refund options in accordance with these Terms and applicable law.
29. Customer Responsibilities
Customers are responsible for providing accurate information, following reasonable safety instructions, arriving on time, respecting staff and other guests, disclosing relevant dietary/allergy information, and complying with these Terms and applicable law.
30. Group and Private Bookings
The person making a group or private booking is responsible for communicating relevant booking terms and arrival information to members of their group and, where applicable, ensuring payment obligations are met.
31. Complaints
We want guests to raise problems promptly so that we have a reasonable opportunity to address them during or immediately after the experience. Complaints can be sent to Dine@culinarycruiser.co.za with the booking details and a description of the issue.
32. Electronic Communications
Customers agree that booking confirmations, invoices, operational notices and other service communications may be sent electronically by email, WhatsApp, SMS or other contact method supplied during booking.
33. Marketing Communications
Marketing communications will be handled in accordance with applicable privacy and direct-marketing laws. Customers may opt out of marketing communications where applicable. Service and booking communications may still be sent where necessary.
34. Website Content
We aim to keep website information accurate and current, but descriptions, prices, routes, menus, availability and other details may change. Website content does not override a specific written booking confirmation where the two conflict, subject to applicable law.
35. Third-Party Booking and Payment Services
Dineplan, Yoco and other third-party providers may have their own terms, conditions and privacy policies. Customers using those services must comply with the relevant third-party terms. Culinary Cruiser is not responsible for third-party systems outside its reasonable control.
36. Consumer Rights
These Terms are subject to the Consumer Protection Act 68 of 2008 and other applicable South African law. Nothing in these Terms is intended to waive or unlawfully limit statutory consumer rights, including rights relating to reasonable cancellation charges and other mandatory protections.
37. Privacy
Personal information will be handled in accordance with the Culinary Cruiser Privacy Policy and applicable South African privacy law.
38. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or severed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.
39. No Waiver
A failure or delay by Culinary Cruiser to enforce a provision of these Terms does not necessarily constitute a waiver of its right to enforce that provision later.
40. Changes to These Terms
Culinary Cruiser may update these Terms from time to time. The version applicable to a booking will generally be the version presented or incorporated into the booking at the time the booking is made, subject to applicable law and any later agreed variation.
41. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of competent South African courts or other legally applicable dispute-resolution bodies.
